Gotland, Sweden, December 11, 2010 ( Notifam ) - A Swedish court has jailed the father of a child taken by the State for having taken her son home for a night visit "unauthorized," reported the League's Legal Defense Home School (HSLDA, for its acronym in English). Christer Johansson, Dominic's father Johansson, is locked up in jail while awaiting trial later this month.
Johansson moved his son to take a supervised visit to see his grandparents and spend a night at home. On Wednesday 24 November, the father phoned police to report that he and Domenic could be found at home. Christer was arrested that same night and was arraigned and held in custody the following Friday.
The child is allowed to see his family only once every five weeks, visits of one hour and under the supervision of the State.
Christer Johansson is being tried for "suspicion of illegal detention" or "implement tough on a child." In accordance with Chapter 4, Section 2 of the Criminal Code that is punishable by imprisonment of not less than a year and a maximum of ten.
Zoom to a minor under fifteen years of social services may constitute a crime against the freedom or the offense of promoting a flight and is punishable by fines or imprisonment up to one year.
But the State is not conducting a trial until Johansson is subjected to psychiatric tests. According to HSLDA, is common in Sweden that when parents oppose State interference with their children are available for them to undergo a psychiatric evaluation and diagnosis. Officials may later present this as a reason why they were justified in placing children in state care.
Mike Donnelly, a lawyer specializing in international cases with the HSLDA, said in the past that the Social Services of Gotland and state officials alike are trying to "cover their tracks" against the international scandal caused by the case .
Ruby Harrold-Claesson , a human rights lawyer and president of the Nordic Committee for Human Rights Human is handling the appeal of the families of Johansson before the European Court of Human Rights. She has reportedly been denied access to Christer while he is in jail.
Harrold-Claesson, who specializes in defending Swedish fathers to whom their children have been snatched by the state, said in October "Never in 20 years of practice I have seen a case so poorly handled. This family has been so traumatized that they may never recover. "
The June 25, 2009, officials of the municipality of Gotland kidnapped Dominic, then eight years old, taking him out without a warrant court of a plane at Arlanda International Airport in Stockholm. Dominic and his parents were on their way to India to work with a humanitarian project. The Johanssons Dominic had planned to place in public schools in India.
Dominic was taken by armed police and handed over to officials and then placed in a foster home, where he has remained ever since. Although Johanssons have not been charged with any crime, a court ruled in October that Dominic could not be returned to the family home. Dominic was born, with the excuse that he had untreated decay in their teeth, nor had been applied last scheduled immunizations by the government.
Gotland Social Services stated that the child exhibited a behavior "deviant" in the school, including who was laughing and hugging other children in the class and kiss on the cheek. Dominic stated that "do not know how to interact with children his age." Social workers, justifying its permanent custody, court told Dominic that education was "delayed" and that he liked to "play with younger children."
In a report on the case, the HSLDA said: "Of course, this means that social workers really believe Dominic should not be raised by their parents, simply because the state has a different opinion of how to educate children. "
